Fact Checking the Initiative IL26-126 Fact Sheet

Recently, proponents of Initiative IL26-126 posted a "Fact Sheet" which was unfortunately loaded with half-truths and outright false statements. We have therefore been forced to post this "Fact Check" of their erroneous "Fact Sheet."

IL26-126 Proponents Claim: There has been a lot of false information put out about Initiative IL26-126 (Requiring Proof of Citizenship When Registering to Vote).

FACT CHECK: The above statement is false. We have written many articles opposing IL26-126 on our website: WashingtonVoterRightsCoalition.org. We have challenged proponents of this Initiative to give us an example of “false information.” So far, not a single sentence in any article has been shown to be false.

What Initiative IL26-126 DOES:

IL26-126 Proponents Claim: “Requires people to provide proof of citizenship when they register to vote.”

FACT CHECK: Only partially true. It also requires 3.5 million existing legal Washington voters - who are already registered to vote - to obtain an “enhanced” (aka real ID) license or they will be removed from the voting rolls and be required to visit their county auditor in person and provide either a valid passport or original certified birth certificate. Married or divorced women will also be required to provide their original marriage and or divorce papers – all of which will be scanned into an insecure centralized national mega database accessible by thousands of election officials and DHS agents all across the US – and thus creating a Hacker Heaven!

IL26-126 Proponents Claim: “Aligns with federal election law and court rulings.”

FACT CHECK: The above claim is false. There are two federal election laws. Both limit voter verification to a sworn statement. Numerous federal courts have already issued injunctions against the Trump Real ID Executive Order - which is essentially the same as IL26-126 – because it violates these two federal laws. State courts have also rejected similar Voter ID schemes – finding that they disenfranchised hundreds of thousands of legal voters who were unable to provide the required documents. IL26-126 Proponents Claim: Effectively audits voter rolls (databases) & cleans up incorrect voter information.”

FACT CHECK: Only partially true. The real problem with voter rolls is a failure to remove voters who have moved or died. The Voter ID Initiative will force county auditors to re-register 70% of their legal voters – a total of 3.5 million people. This will reduce the time auditors have to remove, from the voter rolls, voters who have moved or died – and in addition, the dystopian centralized national Real ID tracking system, once hacked, will allow hackers to remotely change the voter data on any and every voter in Washington state – making our voter rolls even less secure and less accurate than they are now. IL26-126 Proponents Claim: Restores trust and confidence in Washington’s election integrity and security processes.”

FACT CHECK: The above statement is false. Every database security expert in the nation – including the Department of Homeland Security’s own database experts - have opposed creating an Orwellian centralized national mega voter database - due to the ease with which it can be hacked. Attempts to re-register millions of citizens in other states have led to a bureaucratic nightmare - reducing confidence in our election system by making things even worse than they are now!

What Initiative IL26-126 DOESN’T Do:

IL26-126 Proponents Claim: Will not suppress voter registration in any way.”

FACT CHECK: The above statement is false. Studies indicate that 4% to 8% of all current legal voters will not have access to the documents they need to re-register. This will include women, poor people, minorities and senior citizens. The total number disenfranchised will be between 200,000 to 400,000 legal voters. This is one more of several reasons why every federal court that has made a ruling on this violation of federal law has ruled against it. IL26-126 Proponents Claim: Will not change current voting in any way.”

FACT CHECK: The above statement is false. Any person without an Enhanced Drivers License (3.5 million Washington voters) will be removed from the voter rolls and will be required to jump through hoops to get back on the voter rolls.

IL26-126 Proponents Claim Will not require anyone to buy an enhanced license.”

FACT CHECK: Only partially true. The only way to avoid being removed from the voting rolls is to buy an enhanced Washington drivers license ($180 for 8 years). There are no exceptions. Even having a valid passport will not keep you on the voting rolls. If you are one of the 3.5 million Washington voters who do not have an Enhanced WA Drivers License, you will be removed from the rolls and required to visit your county auditor in person and provide them with either a valid passport or certified Birth Certificate (as well as marriage and divorce papers).

A better option to improving our voter rolls is to file a complaint with the US DOJ against Bob Ferguson & the Washington DOL:
There is a way to increase the accuracy of our voter rolls – namely by addressing the ROOT CAUSE of the problem– which is Bob Ferguson and his cronies in his Department of Licensing - who are violating federal election laws by registering thousands of non-citizens!

Rather than forcing millions of legal voters to re-register, we need to force Ferguson & his DOL cronies to comply with federal election laws – by filing a complaint with the US Department of Justice!

Three Estimates of the Size of the Non-citizen Voter Registration Problem in Washington State

On August 7, 2025, Glen Morgan published a video in which he provided evidence that Washington State has a major problem with huge numbers of non-citizens being registered to vote here in our state. Here is a link to his 33 minute video which I hope you will take the time to watch:

At the end of his video, he stated that the “first step in solving a problem is admitting that a problem exists.” Ironically, this is exactly what I told my students during my 20 years of teaching problem solving courses at Bellevue College. We will therefore summarize the evidence presented by Glen and then compare it to two studies I have done on the same subject. The fact that all three studies, using completely different methods and data sets show a huge number of non-citizens being registered to vote in our state is strong evidence that this problem with huge numbers of non-citizens being on our voter rolls does indeed exist. At the end of this article, we will review some possible solutions to this problem.

Glen began with the results of data from the Franklin County Auditor that 14% of their Active voters do not have Social Security numbers associated with their voter registrations. Similar data was collected for 29 of Washington’s 39 counties leading to the conclusion that over 700,000 Washington voters do not have a Social Security card associated with their registration.

Even more concerning, about a half of one percent, or 25,000 voters do not have either a Drivers License or a Social Security number associated with their voter registration.

Glen then pointed out that our Secretary of State is clearly not telling the truth when he claims that they use Social Security data to verify that voters are actually citizens.

Glen then cites the 2024 Annual Report of Washington State Elections to estimate that 53% or more of voters are registered by the Washington Department of Licensing:

Here is the table on the last page of this report confirming that in 2024, 53% of “registration transactions” occurred at the Department of Motor Vehicles.

My own estimate from other data is that over 90% of all new voter registrations occur through the DMV. Nearly all of the other “transactions” occurring in other places are address changes, name changes and other changes for existing voters.

Statistical Analysis also confirms we have a growing problem with non-citizen and ghost voters

Several years ago, I used statistical analysis analysis to estimate that the size of the non-citizen and ghost voter problem was between 500,000 to 1 million ghost voters that could not be accounted for by the normal population growth here in Washington state. Here I will show just a small part of the analysis using the Voter Transactions table displayed at the above link and shown in the table below:

Briefly, you can see from the highlighted line above that the year 2020 was extremely unusual. Motor Vehicle and Online Transactions that year combined for 1 million transactions. Click on the plus sign to show the monthly transactions and you will see that most of these transactions occurred in September and October of 2020. Compare this total to 2024 when they combined for 900,000 – 100,000 less than 2020 despite a growth in population.

Also look at 2008 when combining the two columns on the right, there was only 245,000 transactions, 2012 when there was a 50% jump to 400,000 transactions (despite a population increase of about 5%) and 2016 when there was an unexpected jump to 760,000 – nearly a 100% increase despite a 5% population gain. Then the 1 million in 2020 for a 30% jump despite a 5% population gain.

In short, there were about 300,000 more registration transactions in July through October 2020 compared to prior years. This was despite the fact that there was no change in the rate of population increase from 2008 to 2020. This change is well outside of what can be explained by normal or random statistical variation for such a large sample size.

The average change in population between Presidential elections was about 5 percent. This was also the average rate of voter registration increases. Increases in 2000 and 2016 were at the outside edge of what can be explained by normal or random statistical variation for such a large sample size. The 2020 increase is way outside the range of what could be explained by normal or random statistical variation for such a large sample size

It does not take a statistical expert to see that none of these graphs are statistically possible – and that it all began back in 2010 and it got much worse peaking with the 2020 election.

We do not need to look far for an explanation. Here is the note just below the Table on the Secretary of State website:

Prior to 2008, Motor Vehicle registrations involved the Department of Licensing providing a form that customers could return if interested in registering to vote. In early 2008, DOL began electronically transmitting customer information to the Secretary of State, requiring no effort on the part of customers that wished to opt in. In July of 2019, Automatic Voter Registration (AVR) was implemented and individuals applying for or renewing an Enhanced Washington Driver’s License or Identification card are automatically registered to vote or have their registration information updated unless they opt out.”

Other examples of highly unusual Washington Voter Registration data

In Washington, an additional one million total ballots were counted in the 2020 Presidential Election (4 million ballots versus 3 million ballots) – an increase of 33% - despite a population increase of only 5% since 2016. Mail In Ballots increased by 33% as Washington is an All Mail In Ballot state – over six times the rate of population growth. Keep in mind that even the 15% increase in Registered voters was outside the range of values. The maximum that can be explained by normal variation is 10% and the expected increase is 5% of 4 million which is 80,000. So the increase of 1 million implies about 900,000 unexplained ballots being counted in 2020.

There is a well known principle in statistics called Regression toward the Mean. It means that the larger the sample size is, the more likely it will tend towards the average. Statical principles may not mean much to most people, but as a person with a degree in Science Education who has spent a lifetime studying scientific data, statistical principles matter to me. Washington state has a huge number of voters. Thus, there should be very little variation in the trend lines. The fact that there have been huge variations in the trend lines of voter registrations and name changes in recent years is evidence that something is very wrong with our voter rolls.

2004 to 2020 Washington Presidential Election Ballots
We can compare elections over time to see if there is a change in the trend line of the ballots to population ratio. The average of the previous 4 Presidential elections was 3 million votes plus or minus 100,000 votes. The 2020 election suddenly skyrocketed by a million ballots to an amazing 4 million votes. This dramatic change can not be explained by a population increase because Washington’s population growth rate has not changed much over this period (it has increased by about 100,000 per year):

But a closer look at the data reveals an even more ridiculous set of facts. Here is a summary of voter registration increases and Mail In Ballot increases compared to population increases in Washington state since 2016. From 2016 to 2020, the Washington State population rose from about 7.3 million to about 7.7 million – an increase of about 400,000 or about 5%. According to the US 2020 Census, 21% of the Washington State population is under 18. Therefore the increase in the voting age population was .79 x 400,000 or 316,000. During this same time, the number of registered voters rose from 4.27 million to 4.89 million – an increase of about 620,000 or 13%. In short, all 316,000 of the new voting age population who moved to Washington State between 2016 and 2020 registered to vote - PLUS an additional 303,000 people who already lived here registered to vote. In addition, 530,000 of the 620,000 or 85% of this increase occurred in a single year – 2020.

Even more remarkable, during this same time, the number of ballots counted rose from 3,363,440 in the 2016 General Election to 4,116,894 in the 2020 General Election – an increase of 753,454 ballots or 18.3%.

Even more remarkable, during this same time the number of ballots in the Presidential Race rose from 2,964,465 in 2016 to 3,954263 in 2020 – an increase of 989,798 ballots or 33%. Even if every new voting age person was registered to vote, an increase of 316,000 in new registered voters times an 80% turn out rate would lead to 0.8 x 316,000 or 253,000 additional ballots. Yet the actual increase in the 2020 Presidential race was 989,798 additional ballots. Thus, there appears to be 500,000 to 700,000 additional Mail In Ballots in 2020 - even after accounting for the increase in population – which is completely out of the trend line for any election in Washington state for the past 20 years.

This leads to an obvious question: How could the actual increase in the number of Presidential ballots in 2020 be more than six times the increase in state population? Where did the unexplained 500,000 to 700,000 additional ballots counted come from?

US Census Data also confirms we have a growing problem with non-citizen and ghost voters
One weakness of both the study provided by Glen Morgan and my statistical analysis is that neither can be connected directly to non-citizens being registered. These unexplained voters could also be due to “ghost” voters or voters who do not actually exist but are inserted into the voter rolls by people interested in using these non-existent voters to artificially rig elections. To correct for this problem, two weeks ago, I published a study of non-citizens living here in Washington state according to the US Census Bureau. Scroll down to Problem #8 to read this study. Here are quotes from this study: “According to the US Census, about 600,000 people living in Washington state are foreign born and not US citizens. Next, we need to estimate the percent of non-citizens registered to vote in our state. This unfortunately is going to be a very high figure since our Department of Licensing is registering voters automatically when they get a drivers license (this is a topic we will discuss in greater detail below).”

A detailed study published in 2024 estimated that 10% to 27% of illegal aliens are registered to vote in the US. While others have criticized this study and claimed that the actual number is 1% to 10% of illegal aliens registering to vote, I have reviewed the 2024 study and concluded it was accurately done. Given how bad things are here in Washington, with the Washington Department of Licensing automatically registering non-residents, I estimate that 20% of non-residents are being registered to vote here in Washington. This would put the number of non-resident registered voters in our state at 120,000.”

However, it could be as high as 600,000 to one million, given that there are huge numbers of illegal aliens in our state not in the US Census data.

Understanding the Source or Cause of the problem
Glen correctly identified the cause of the problem as the Washington State Department of Licensing. Here is his cartoon about what happens there:

Proposed Solutions
Glen points out that the Department of Homeland Security already has a list of non-citizens in the US (at least the ones here legally). Glen suggests that the Department of Homeland Security simply publish the list of non-citizens on their website. Then we citizens can take these lists to our county auditor to get them removed from our voter rolls.

While this would certainly be an easy quick fix to get the voter rolls at least partially cleaned up in the short run, it does not address the underlying problem which is that it is illegal under both state and federal laws for the Department of Licensing to be registering non-citizens to vote in the first place. It is also illegal under federal law for the Washington Department of Licensing to give non-citizens normal Washington Drivers Licenses. The Department of Licensing should be issuing special “non-citizen” Drivers Licenses to non-citizens.

Thus, we need to get Pam Bondi and the US Department of Justice out here to force Bob Ferguson and his Department of Crazy People to start complying with state and federal election laws. This will likely not happen until we get new federal attorneys for the Eastern and Western Districts here in Washington. The good news is that a couple days ago, Pasco Mayor Pete Serrano, who last year ran as the Republican candidate for Washington state attorney general, was tapped by President Trump as the new U.S. Attorney for the Eastern District of Washington. Serrano is a former lawyer with the U.S. Department of Energy, and is also a former Franklin County Republican Party Chairman. Serrano is also a staunch supporter of election integrity. The U.S. Attorney’s Office Eastern District is located in Spokane. Serrano’s expected selection will have to be considered by the U.S. Senate in the next two months.

The Trump administration is likely to announce a permanent person for the Western District in Seattle in the coming weeks. Once confirmed by the US Senate, it is likely to take the two new US attorneys a couple of months to replace Biden loyalists in Spokane and Seattle. It will take a couple more months for them to complete their investigations and write their federal complaints. So expect federal complaints to be filed in Spring 2026.

It might take a year or two in federal court – and likely a US Supreme Court ruling - to get Ferguson to comply with all of the federal laws he has been breaking. But it is the only way to stop this problem and several other crimes at its source. This will have the additional benefit of letting Washington voters know that Bob Ferguson has been violating several federal election laws and several federal civil rights laws during the past 10 years. More on these federal election laws in our next article.
